1. Acceptance of Terms

Pizza Luce is a food service establishment offering a variety of artisan pizzas, appetizers, salads, sandwiches, beverages, desserts, and other food and drink items ("Products"). Our Services include, but are not limited to:

3. User Obligations and Prohibited Activities
3.1 User Obligations

- Impersonating or attempting to impersonate Pizza Luce, a Pizza Luce employee, another user, or any other person or entity.
- Using any robot, spider, scraper, or other automated means to access or collect data from the Site without our prior written consent.
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Site or any related software.
- Interfering with or disrupting the integrity or performance of the Site, its servers, or any networks connected thereto.
- Collecting or harvesting any personally identifiable information from the Site without authorization.
- Placing fraudulent orders or providing false payment information.
- Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by Pizza Luce in its sole discretion, may harm Pizza Luce or users of the Site or expose them to liability.
- Circumventing, disabling, or otherwise interfering with security-related features of the Site.
- Using our Services to conduct any form of market research or competitive intelligence gathering without prior written consent from Pizza Luce.
Violation of any of the above prohibited activities may result in the immediate termination of your access to our Services, and may subject you to civil or criminal liability. Pizza Luce reserves the right to cooperate fully with law enforcement authorities and to disclose your identity and usage information when required to do so by law or when we believe disclosure is necessary to protect our rights or the safety of others.
4. Intellectual Property Rights
The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, photographs, images, logos, trademarks, trade names, service marks, button icons, illustrations, audio or video clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof — are the exclusive property of Pizza Luce and/or its licensors and are protected by the intellectual property laws of the United States, including but not limited to the Copyright Act (17 U.S.C. § 101 et seq.) and applicable trademark laws.
The name "Pizza Luce," the Pizza Luce logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pizza Luce or its affiliates. You may not use such marks without the prior written permission of Pizza Luce. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial use in connection with our Services. This license does not include any right to:
- Reproduce, distribute, publicly perform, or publicly display the Site or its content;
- Modify or create derivative works based upon the Site or its content;
- Use the Site or its content for any commercial purpose or for any public display, commercial or non-commercial;

5. Payment Terms
5.1 Pricing and Payment
All prices for our Products are listed in United States Dollars (USD) and are subject to change without prior notice. The price charged for an order will be the price in effect at the time the order is placed. Sales tax will be applied to orders as required by applicable federal, state, and local tax laws.
We accept various forms of payment, including major credit cards (Visa, MasterCard, American Express, Discover), debit cards, and any other payment methods we may make available from time to time. By providing payment information, you represent and warrant that (a) you are authorized to use the payment method provided, (b) the payment information you provide is accurate and complete, and (c) you authorize Pizza Luce to charge the full order amount, including applicable taxes and delivery fees, to your specified payment method.
5.2 Order Confirmation
Upon successful placement of an order, you will receive an order confirmation via email. This confirmation does not constitute our acceptance of your order or a guarantee of availability. We reserve the right to cancel or refuse any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, or suspected fraudulent activity.
5.3 Delivery Fees and Minimums
Delivery orders may be subject to a delivery fee and/or minimum order amount as specified at the time of checkout. Delivery fees and minimums are subject to change without notice. Delivery availability and timing may vary based on your location and our operational capacity at any given time.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final. However, if you receive an incorrect order or a product that does not meet our quality standards, please contact us within a reasonable time of receipt. We will review your concern and, at our sole discretion, may offer a replacement, credit, or refund as appropriate. Cancellation of orders may only be possible before the order has been prepared or dispatched for delivery, and is subject to our operational discretion.
5.5 Gift Cards
Pizza Luce gift cards are redeemable for food and beverages at participating Pizza Luce locations or through our online ordering platform. Gift cards are not redeemable for cash unless required by applicable law, are non-transferable, and may not be applied toward gratuity. Pizza Luce is not responsible for lost, stolen, or damaged gift cards.
6. Disclaimers
YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK. THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZA LUCE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SITE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR CURRENCY OF ANY INFORMATION, CONTENT, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SITE;
- WARRANTIES THAT DEFECTS, IF ANY, WILL BE CORRECTED;
- WARRANTIES THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Pizza Luce makes no warranty or representation regarding the results that may be obtained from the use of the Site or Services, or as to the accuracy or reliability of any information obtained through the Site. No advice or information, whether oral or written, obtained by you from Pizza Luce or through the Site shall create any warranty not expressly stated in these Terms.
Allergen Notice: While we make every effort to identify allergens in our Products and provide accurate nutritional information, our kitchen handles common allergens including but not limited to gluten, dairy, eggs, nuts, soy, and shellfish. We cannot guarantee that any product is completely free from allergens. Customers with severe food allergies are encouraged to contact us directly before placing an order. Pizza Luce disclaims all liability for allergic reactions or other adverse health events resulting from the consumption of our Products.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIZZA LUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SUBCONTRACTORS, SUPPLIERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- DAMAGES ARISING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
- DAMAGES ARISING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
- DAMAGES ARISING FROM ANY FOOD PRODUCT, INCLUDING BUT NOT LIMITED TO ALLERGIC REACTIONS, ILLNESS, OR OTHER HEALTH-RELATED ISSUES, EXCEPT WHERE SUCH LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PIZZA LUCE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
IN ANY CASE, PIZZA LUCE'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PIZZA LUCE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, PIZZA LUCE'S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms;
- Your use of the Site or Services, including but not limited to any content you submit, post, transmit, or make available through the Site;
- Your violation of any third-party rights, including intellectual property rights or privacy rights;
- Your violation of any applicable law, rule, or regulation;
- Any claim that your use of the Site caused damage to a third party;
- Any fraudulent, deceptive, or illegal activity by you in connection with your use of our Services.
Pizza Luce reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Pizza Luce in asserting any available defenses. You agree not to settle any such matter without the prior written consent of Pizza Luce.
9. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Pizza Luce is principally domiciled, without regard to its conflict of law provisions.
You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal or state courts of competent jurisdiction located in the United States. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
These Terms are subject to all applicable federal laws of the United States, including the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive acts or practices in commerce. To the extent applicable, these Terms are also subject to the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA) for California residents, and any other applicable state consumer protection statutes.
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first contact Pizza Luce directly and attempt to resolve any dispute informally. You may contact us at [email protected]. Pizza Luce will make good faith efforts to resolve the dispute within thirty (30) calendar days of receiving your written notice describing the nature and basis of the dispute and the relief sought.
10.2 Binding Arbitration
If the parties are unable to resolve the dispute through the informal process described above, you and Pizza Luce agree that any dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or your use of the Site or Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org.
The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator may award any relief that a court of competent jurisdiction could award, including attorneys' fees when authorized by law. The filing fees and arbitrator's compensation shall be governed by the AAA's Consumer Arbitration Rules.
10.3 Class Action Waiver
YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Luce agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Nothing in this section shall limit either party's right to pursue any claim for intellectual property infringement in a court of law.

Our Site may contain links to third-party websites, services, or resources that are not owned or controlled by Pizza Luce. These links are provided solely as a convenience and for informational purposes. Pizza Luce has no control over the content, privacy policies, or practices of any third-party sites and expressly disclaims all responsibility for them.

Pizza Luce does not endorse, recommend, or make any representations about the accuracy, completeness, or reliability of any content, products, or services available on or through third-party sites.

12. Term and Termination
These Terms are effective from the date you first access or use the Site and shall remain in full force and effect until terminated in accordance with these Terms.
Pizza Luce reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site and Services, with or without notice, for any reason or no reason, including but not limited to:

- Requests by law enforcement or government agencies;

If any provision of these Terms is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or, if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect as if the invalid, illegal, or unenforceable provision had never been included.
The invalidity or unenforceability of any provision of these Terms in any jurisdiction shall not affect the validity or enforceability of any other provision of these Terms in that jurisdiction or any provision of these Terms in any other jurisdiction. These Terms shall be interpreted to give maximum effect to the parties' original intent as reflected in these Terms.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices, policies, or guidelines published by Pizza Luce on the Site, constitute the entire agreement between you and Pizza Luce with respect to your use of the Site and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the same subject matter.
Any failure by Pizza Luce to enforce any right or provision of these Terms shall not be construed as a waiver of such right or provision. The section headings in these Terms are for convenience only and have no legal or contractual effect.

17. Force Majeure
Pizza Luce shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, public health emergency, war, terrorism, civil unrest, labor disputes or strikes, governmental actions, power outages, internet service disruptions, or supply chain failures.
In the event of a force majeure event, Pizza Luce will use commercially reasonable efforts to notify affected customers and to resume normal operations as soon as reasonably practicable. Affected orders may be canceled or rescheduled, and refunds will be issued in accordance with our Refund Policy where applicable.
